Novo Nordisk Takes Legal Action Over Impure Weight-Loss Drug Claim

Novo Nordisk initiated legal action against compounding pharmacies, alleging impurities in their versions of the weight-loss drug Wegovy. The Danish pharmaceutical company refiled a lawsuit against one and sued another after discovering impurities, some samples containing 33% impurity.
Wells Pharmacy and Brooksville Pharmaceuticals, both Florida-based, faced allegations of impure formulations containing semaglutide, Wegovy’s active ingredient. Novo Nordisk’s previous suit against Brooksville, initiated in July, was refiled, while new allegations against Wells emerged, including the presence of BPC-157, banned by the FDA due to potential harm to humans.
Brooksville disputed these claims, planning to file a motion to dismiss, while Wells Pharmacy remained unresponsive to inquiries. The FDA’s ban on BPC-157 in compounded drugs heightened concerns about patient safety.
Novo Nordisk emphasized that compounded drugs lack FDA-approved safety, quality, and effectiveness, posing significant health risks. They seek to prevent the sale of purported semaglutide-containing products and ensure pharmacies inform customers of potential safety risks associated with BPC-157.
Brooksville defended its product sourcing from FDA-registered facilities, asserting potency for specified durations under different storage conditions.
Novo Nordisk has pursued legal action against numerous establishments falsely claiming to offer semaglutide-based products. Eli Lilly, their competitor in obesity medications, similarly pursued legal action against entities selling products claiming to contain tirzepatide, an active ingredient in their drugs Mounjaro and Zepbound.
The lawsuits were filed in Florida, seeking to halt the sale of purported drugs containing semaglutide or tirzepatide. These legal actions underscore the pharmaceutical industry’s stringent measures against unauthorized formulations that compromise drug safety and authenticity.
